The Community Rules and Fine Policies for Parmer Village Condominium Community, Inc. (the “Association”) shall include, but are not limited to, the following guidelines: Please see the full and complete bylaws and rules documents for further information.
IN THE EVENT OF A CONFLICT BETWEEN THIS GUIDE AND ANY ASSOCIATION “DEDICATORY INSTRUMENT”, AS THAT TERM IS DEFINED IN SECTION 202.001 OF THE TEXAS PROPERTY CODE OR ITS SUCCESSOR STATUTE, THE DEDICATORY INSTRUMENT WILL CONTROL. THIS DOCUMENT IS INTENDED AS A GUIDE TO THE ASSOCIATION’S DEDICATORY INSTRUMENTS AND IS NOT INTENDED TO TAKE THE PLACE OF ANY SUCH DEDICATORY INSTRUMENT.
1.1 LAWN: Lawn turf coverage should be maintained such that the lawn is uniform turf, weed free, mowed consistently, watered appropriately (within Austin water guidelines) to less than 6” and all sidewalks and shrub/flower beds edged and weeded.
1.2 SHRUBS: Three to five shrubs in the front yard are required for each unit. Shrubs should be maintained so they are kept consistently trimmed and do not overgrow sidewalks, driveways, block house lights or garage doors. Shrubs should be maintained similar to original design and intent when the unit was built.
1.3 TREES: Maintain trees by removing dead limbs and trimming any low hanging branches that extend over sidewalks, streets or driveways to a minimum of 7 feet in height. Trees should be trimmed at a time of year appropriate for the species of trees. (ie Oaks only July – Jan to avoid Oak wilt other times of year). Dead trees in the front yard should be replaced with mature trees of similar species (ie Red Oak to Red Oak, Live Oak to Live Oak etc). Each unit is required to have at least one Oak tree in the front yard. Stakes must be removed when the tree is stable and rooted (12 months maximum).
1.4 Xeriscaping is allowed to 50% of the front of the property pending Architectural Reviewer (AR) approval. Xeriscape is an organized landscape design that incorporates plants that hardly need any water. 50% of your front lawn must still contain sod. All Xeriscape areas must be maintained weed free and trimmed appropriately similar to shrub and lawn requirements listed under Sections 1.1 and 1.2 of the Maintenance guidelines for the community Zeroscaping will NOT be allowed. Zeroscape is a landscape design made up of dirt or gravel with essentially no plants in it.
1.5 PAINT: Maintain home by painting siding, garage doors (including black accents) and all trim/accessories when paint is fading and cracked or in general poor appearance (dry rot, extremely faded paint, missing shingles, damaged/loose siding, mold, etc.)
Replace/repair broken or cracked siding, gutters, exhaust covers, pipes and windows or any items that are not in original condition. Main House color includes Siding, most Garage doors, and Pillars. TRIM color includes all window trim, door trim, garage trim, eaves, gutters, shutters, pillar trim, railings, corner vertical trims and any other similar items.
1.6 ROOF: Roof should be maintained such that any cracked, broken or missing shingles are replaced and any broken/damaged trim, pipes, gutters, soffit and facia are also repaired/replaced to keep the roof in original condition.
1.7 DRIVEWAYS/SIDEWALKS: Maintain driveways and sidewalks along property frontage by removing oil stains, vegetative growth in cracks and along edges. Staining/Painting sidewalks or driveways is not allowed with the exception of professionally painting your address numbers at the edge of the driveway/sidewalk. Sidewalk chalk designs are allowed as long as it washes away.
1.8 FENCE/GATES: Maintain fence and gates in good working order with no broken or missing boards. Fence should also be maintained in an upright position as installed and not lean or become a hazard for neighbors or passersby. Staining or altering fence color that differs from the original color (Honey Teak) will require an Architectural control application and approval by the Architectural Control Committee. Wood or metal posts are allowed. Vinyl/metal fencing are NOT allowed.
1.9 TRASH/RECYCLE BINS/OTHER: The visible Exterior of the property must be kept neat and free of items including but not limited to garbage and recycle receptacles, rain barrels, landscaping debris/trimmings, construction supplies, empty pots, bikes, toys, etc. Storing items on the sides of the house is not allowed. Items that do not fit in trash/recycle receptacles that are to be placed out for trash/recycle/bulk pickup should not be placed at the roadside more than 48 hours in advance and should be placed neatly so as not to inhibit the sidewalk or street in any way. Trash and Recycle cans/bins should not be placed out until after 3pm the day before the scheduled collection day and should be returned behind the fence or in the garage before 8am the following day. Trash and Recycle Bins are to be stored out of sight behind a fence or in the garage except as stated above.
1.10 ADDRESS NUMBERS: House address numbers must be posted next to the front door and clearly visible from the street to aid emergency vehicles. Original House Numbers should be painted black.
2.1 Pool will have limited cleaning and maintenance from October 1 until March 1 and the pool itself along with the restrooms may be closed when temperatures are forecasted to reach freezing or below. Pool furniture will also be stacked in the sheltered area during this timeframe but is available for use by residents and their guests but should be returned to the protected location when not in use.
5.1 Overnight Parking – No vehicles are permitted to be parked on streets between the hours of 1am-6am 7 days per week. All vehicles parked on the street during these hours will be subject to towing at the vehicle owner’s expense. Residents are responsible for ensuring guests adhere to this policy. See section I-8 of the Community Manual for additional details on Violations
5.2 Street Parking – Street parking should be avoided whenever possible and designated overflow/visitor parking spaces should be utilized. Any vehicle repeatedly parking on the street when visitor spaces within a reasonable distance (2-3 blocks) is available may be towed at the vehicle owner’s expense. Residents are responsible for ensuring guests adhere to this policy. See section I-8 of the Community Manual for additional details on Violations
5.3 Visitor/Overflow Parking. Residents should use their own garages and driveways whenever possible and only use visitor parking on a temporary short-term basis as needed. Visitor/Overflow parking should be reserved for visitors to the neighborhood and any vehicle found to be parked in these spaces long term or excessively may be subject to towing at the owner’s expense. Residents are responsible for ensuring guests adhere to this policy. See section I-8 of the Community Manual for additional details on Violations
6.1 Lights or decorations may be erected on the exterior of residential units in commemoration or celebration of publicly observed holidays provided that such lights or decorations do not unreasonably disturb the peaceful enjoyment of adjacent Owners. All lights and decorations must not be permanent fixtures of the home without prior written approval of the ACC. Decorations can be erected up to (45) days before the holiday and shall be removed within thirty (30) days after the holiday has ended.
7.1 Satellite dishes should be placed in the back of the house whenever possible or as inconspicuously as possible using the following guidelines. In the event of any conflict between these rules and State or federal laws, the State or federal law will control.
7.1.1 Satellite dishes, attached to the back of residence with no part of the Permitted Antennae any higher than the lowest point of the roofline and screened from view of adjacent lots and street.

7.1.3 Mounted behind and below side fence of home and screened from view of adjacent Lots and the street The satellite dish installation guidelines listed above are the responsibility of the homeowner to enforce; it is recommended that the installer of each satellite dish is made aware of these requirements in advance of installation.
8.1 Solar Panels must be installed on the roof of the home or within the fenced yard. Roof mounted Solar Panels will not require prior approval provided they meet the below guidelines and are installed professionally be certified installers and electricians and all proper permits are obtained by the owner. Yard mounted solar panels will require prior approval by the AR.
Roof Mount:
A) No part of the installation may extend higher than or beyond the roofling
B) Must conform to the slope of the roof and must not have a top edge that is not parallel to the roofline
C) Frames, support brackets, piping, wiring and other necessary accessories must be in a color commonly available in the marketplace such as silver, bronze, or black tone or painted to match the house exterior where appropriate.
Fenced Yard:
A) Must not extend above the Fence line
B) Must be installed such that is does not void material warranties
C) Must not constitute a condition that substantially interferes with the use and enjoyment of land by causing unreasonable discomfort or annoyance to persons of ordinary sensibilities. For purposes of making a determination under this subsection, the written approval of the proposed placement of the device by all property owners of adjoining property constitutes prima facie evidence that such a condition does not exist
No window air-conditioner units are allowed at anytime without prior AR application and approval.
9.1 Fee Schedule
1st Notice of Violation - Letter (no fine)
2nd Notice of Violation - Fine of $50 + cost of shipping (certified letters)
3rd Notice of Violation - Fine of $75 + cost of shipping (certified letters)
4th Notice of Violation - Fine of $100 + cost of shipping (certified letters)
All violations moving forward will increase in increments of $50.
*If violations are not rectified or HOA notified within 14 days, the HOA or its agent may resolve the issue at owner’s expense. See Article 6 (Enforcement) in the Community Manual.
9.1.1. Fines. Fines can and will incur for violation of any of the items listed in the Declaration, Community Manual, Bylaws, or other dedicatory instrument, as that term is defined in Section 202.001 of the Texas Property Code or its successor statute, of the community. Unless another cure period is established by the Board, you have 14 days from the date of violation letter to rectify the matter stated or notify HOA/Management Company by email if more time is needed. You are allowed to appeal the fine.
9.1.2 Unless a different cure period is established by the Board, All violations must be cured in 14 days to avoid a fine or suspension. If corrective action is not taken within 14 days, the Association can, in its discretion, refer this violation to the Association's attorney for a legal remedy, send crews onto the property to remedy the violation, or impose a fine according to the Association's fining policy. This fine will be incurred and will become part of the Owner’s assessment obligation. The charges associated with the attorney, crews and/or fine will be billed to the homeowner's account. Furthermore, the Board may impose the following sanctions: (a) reasonable monetary fines which may constitute a lien (b) suspension of any Person's right to use the community amenities within the Common Area. Owner’s have the right to a hearing to verify the facts and resolve the dispute. A written request must be made for this hearing within 30 days after the date of the letter. If the hearing is held before a committee, the requestor will have the right to appeal the committee's decision to the board of directors by written notice to the board of directors.
9.1.3. Self-Help. After notice and an opportunity to be heard are given, except in case of an emergency, the board or an agent acting on behalf of the board may enter the Unit or Common Element in which, or as to which, the violation or breach exists and to summarily abate and remove, at the expense of the defaulting Owner, any structure, thing, or condition (except for additions or alterations of a permanent nature that may exist in that Unit) that is contrary to the intent and meaning of the provisions of the documents. The Board or agent may not be deemed liable for any manner of trespass by this action. Examples of such actions include, but are not limited to, trimming of trees, returning trash and recycle cans to behind the fence, cutting of lawn, removal of debris, trimming bushes, or repair of a fence.
