This First Amendment to Rules and Regulation for Parmer Village Condominiums is made and executed by the PARMER VILLAGE CONDOMINIUM COMMUNITY, INC., a Texas non. profit corporation (the "Association"), acting by and through its Board of Directors (the "Board"), and is as follows:
A. CONTINENTAL HOMES OF TEXAS, L.P., a Texas limited partnership ("Declarant") previously executed that certain Declaration of Condominium Regime for Parmer Village Condominiums recorded as Document 20080 55647, Official Public Records of Williamson County*. Texas, as amended (the "Declaration"). The Declaration establishes Parmer Village Condominiums, a condominium regime located in Travis County, Texas created pursuant to Chapter 82 of the Texas Property Code (the "Regime").
B. Pursuant to Section 1.33 of the Declaration, Declarant Inas adopted the initial rules and regulations for the Regime (the "Initial Rules"), which Initial Rules were included within the Parmer Village Condominiums Community Manual recorded as Document No. 2008055648, Official Public Records of Williamson County, Texas (the "Community Manual").
C. Section 11.2 of the Declaration provides that the Association, acting through the Board, is granted the right to adopt, amend, repeal, and enforce the Rules (as defined in the Declaration, and including the Initial Rules), and penalties fog infractions thereof, regarding the occupancy, use, disposition, maintenance. appearance, and enjoyment of the Property (as defined in the Declaration).
D. The Board now desires to amend the Initial Rules as set forth hereinbelow.
NOW, THEREFORE, the Initial Rules are hereby amended as follows:
1. On Street Parking. Section 1-2 of the Rules is hereby deleted in its entirety and the following is substituted in its place:
1-2. On Street Parking. No vehicle may be parked on any road or street within the Properly overnight unless in the event of an emergency. "Emergency" for purposes of the foregoing sentence shall mean an event which jeopardizes life or property. "Parked" as used herein shall be defined as a vehicle left unattended for more than thirty (30) consecutive minutes. For overnight parking purposes, vehicles shall be restricted to parking only in garages, driveways in front of garages or in parking spaces provided adjacent to streets. Vehicles found to be in violation of this rule are subject to towing at the vehicle owner's expense.
2. Garages. Section 1-7 of the Rules is hereby deleted in its entirety and the following is substituted in its place:
1-7. Garages. Because of a limited amount of visitor parking within the Property, it is imperative that each Resident endeavor to utilize their garage for the parking of vehicles. No garage may be enclosed, remodeled or modified for any purpose that prevents the parking of the maximum number of vehicles for which it was constructed.
3. General Duty. Section J-1 of the Rules is hereby deleted in its entirety and the following is substituted in its place:
General Duty: Resident will endeavor to keep the Property clean and will dispose of all refuse in receptacles designated specifically by the Association or by the city for that purpose. Receptacles, except on designated refuse collection days, shall be kept in a place out or public view in either the garage, behind the fence, or behind a screened enclosure that has been approved in advance by the Architectural Reviewer. Residents may NOT litter Common Elements.
4 Excess Trash. Section J-3 of the Rules is hereby deleted in its entirety and the following is substituted in its place:
J-3 Excess Trash. Residents will place trash entirely within the designated receptacle, and may place trash outside, next to, or an top of the receptacle. Boxes and large object(s) should be crushed or broken down before being placed in or next to a receptacle. Residents must arrange privately for removal of discarded furnishings or any unusually large volume of debris.
5. Miscellaneous. Any capitalized terms used and not otherwise defined in this instrument shall have the meanings set forth in the Declaration
